Section 1: Preamble
This regulation in addition to other regulations and codes shall control the installation of private wells, whether for potable water supply, irrigation or other purposes, within the Town of North Reading. Its purpose is to prevent cross connection between private and municipal water distribution systems and to ensure that minimum horizontal setback distances between private wells and some sources of contaminants are met.
Section 2: Authority
The North Reading Board of Health, pursuant to the authority granted under Massachusetts General Laws Chapter 111, Section 31, hereby adopts the following regulation to protect the public health of the community.
Section 3: Installation of Wells
All persons making application with the North Reading Health Department to install wells in North Reading shall be registered with the Commonwealth of Massachusetts as a Certified Well Driller as required under 310 CMR 3.00. Evidence of such registration shall accompany the Well Permit application.
This policy does not relieve the well installer of any other local, state or federal regulations that apply to the installation of wells.
Section 4: Application
Prior to the installation of any well within the Town of North Reading, the well installer shall file a Well Permit Application along with a $10.00 fee with the North Reading Board of Health. Well Permit applications are available at the Health Department in North Reading Town Hall, 235 North Street, North Reading, MA 01864, telephone (978) 664-6042.
Section 5: Location of Wells
Pursuant to the regulations of 310 CMR 15.00, the State Environmental Code Title V, wells shall be located so as to maintain the following minimum setbacks from the following features of subsurface disposal systems:
Well Type Septic Tank Soil Absorption System
Private Water Supply Well
or Suction Line 50 ft. 100 ft.
Irrigation Well 10 ft. 25 ft.
The person installing the well shall be responsible for ensuring that these setbacks are met. A plan showing the location of the well, septic tank, soil absorption system, underground storage tanks, if any and other pertinent features of the property shall be completed and furnished to the North Reading Board of Health. In most cases an “As-Built” plan of the On-Site Sewage Treatment and Disposal System will be on file with the Board of Health and will be made available to the driller.
Section 6: Separation from Public Water System
Pursuant to 310 CMR 22.00, the State Drinking Water Regulations, private wells may not be cross connected with the public water system. At every location (dwelling) supplied by both the public water system and a private well, a physical separation – i.e., separate piping that does not connect – must be maintained between the public water supply and any private well or individual water source. The public water system has the authority to terminate the water service connection to any facility where cross connections are found to exist.
Section 7: Inspection
Upon completion of the well installation, the well installer shall contact the North Reading Board of Health and request a final inspection of the well, and associated plumbing. The well shall not be placed into operation until such time as this final inspection has been completed and the Well Permit is signed by a representative of the Town of North Reading.
Section 8: Penalty
Any person who violates this regulation shall upon conviction be fined fifty dollars ($50.00) each day during which a violation continues shall constitute a separate offense. The Board of Health shall take such legal action as is necessary to enforce this regulation and permits issued pursuant to it.
