Community Planning Commission Minutes 06/21/2005
M I N U T E S


Tuesday, June 21, 2005


Mr. Chris Hayden, Vice Chairperson, called the Tuesday, June 21, 2005 meeting of the Community Planning Commission to order at 7:30 p.m. in Room 5 of the North Reading Town Hall, 235 North Street, North Reading, MA.

Minutes

Mrs. Romeo moved, seconded by Mr. Pearce and voted 5-0:  

that the Community Planning Commission vote to accept the minutes of June 7,  2005 as amended.

Mr. Hayden passed the gavel to Mr. Rooney.

Mrs. Romeo moved, seconded by Mr. Spear and voted 5-0:

that the Community Planning Commission vote to release the Executive Session minutes of January 1, 2005.

Capital Improvements / Infrastructure Planning Committee

Mrs. Rodgers stated that the Board of Selectmen would like the Community Planning Commission to select a member as liaison for the Infrastructure Planning Committee.

Mr. Spear will be the liaison for this committee and Mrs. Romeo will be the alternate liaison.

Cluster Development – William Reed - 7:40PM

Mr. Reed stated that he has been gathering information from other towns. (see attached) He would like to know if the Community Planning Commission is interested in making any revisions.

Mr. Pearce asked if there was any difference in the information gathered from other towns to the Town of North Reading’s bylaw.

Mr. Reed stated that there is not a lot of difference.

There was a miscellaneous discussion on the following:

-       Wetland credits.
-       Density credits.
-       Lexington’s bylaw. (Community Planning Commission is interested)

Stormwater Management – Malcolm Pirney

Mark Clark of the Water Department introduced and outlined the process for stormwater management.  He stated that the requirements for Phase II Stormwater Management comes out of the Clean Water Act of 1970.  

Jennifer Lockmeyer presented a Powerpoint presentation on stormwater permit processing for a new bylaw.  (see attached)  The EPA wants to be sure that under the illicit discharges, North Reading has the regulatory authority to prohibit any non-stormwater discharges into the stormwater system.  The specific requirements will be implemented at all sites that are disturbing one acre of land or greater.  (moving the earth, whether temporary or permanent)  This is the third permit year and by the fifth permit year the EPA will expect that North Reading has the regulatory controls in place for compliance with the general permit.  

Mr. Pearce asked who would be the enforcement agent?

Jennifer Lockmeyer stated that it would be the Building Inspector.

Jennifer Lockmeyer stated that the bylaw draft should be ready for October Town Meeting.

8 Plymouth Street – SPR – cont. P.H. 8:45 PM

Mrs. Romeo recused herself from this discussion.

Tom Romeo stated that he had a conversation with an abutter Mr. Fitzgerald regarding the potential rezoning.  

Ryan Fitzgerald of 7 Plymouth Street stated that he has the petition.  He does not have all of the signatures needed at this time.

Mr. Rodgers stated that when the petition is filed with the Town Clerk, it will then be forwarded to the Community Planning Commission for a Public Hearing for rezoning, the Community Planning Commission would then have to make a recommendation at Town Meeting.  It will then take a two-third vote to rezone.

Tom Romeo stated that from all of these meetings it is clear that the neighborhood would like to change the zoning.  He respects this and supports the change.  He would like to give the neighborhood an opportunity to change the zoning.  Procedurally there may be some issues with the seller and he may have to go forward with his application for the commercial permit.

Mr. Rodgers stated that if the application pre-dates the zoning change the lot would be grandfathered.

Ryan Fitzgerald asked if this land is grandfathered and Mr. Romeo sells the land would the nexte next buyer have the choice to build a commercial building?

Mr. Pearce stated that if a permit is obtained to build a commercial building and the zoning changes, and he does not build within two years the permit will expire and no one would be able to get a permit to build commercially on the property or if the zoning changes and the permit is surrendered and he sells the property, the next owner would have to comply with the new zoning.

Ruth Fierro of 14 Plymouth Street stated that she still has concerns with the drainage.

Mr. Pearce stated that the drainage will be addressed if the applicant goes forward with the application.

Mr. Hayden moved, seconded by Mr. Pearce and voted 4-0:  (Mrs. Romeo abstained)

that the Community Planning Commission continue the Site Plan Review and Determination of Access Public Hearing to August 16, 2005 at 8:00pm.

Kylie Way – 235 Elm Street- Definitive Subdivision – cont. P.H. 9:05PM

Joseph Byrne stated that they have received the Certificate of Conditional Approval from the Conservation Commission.  

Mr. Pearce asked if the plans reflected the changes with the new contours per Green Internationals’ report.

Mr. Rodgers stated that the changes have not been made to the plans.

Mr. Pearce stated that the contours need to be added because this is going to change the topography of the site.

Joseph Byrne stated that there was a revision in May.

Mr. Rodgers stated that the plans submitted to the Community Planning Commission do not show those revisions.

Mrs. Romeo moved, seconded by Mr. Hayden and voted 5-0:

that the Community Planning Commission vote to grant the requested extension of time in which to render a decision on the Definitive Subdivision Plan entitled “Definitive Plan, Kylie Way, North Reading, Mass”; until August 5, 2005 and that the scheduled working meeting be on August 2, 2005 @ 8:30PM..
