Mr. Christopher Hayden, Chairman, called the Tuesday, March 1, 2005 meeting of the Community Planning Commission to order at 7:31 p.m. in Room 10 of the North Reading Town Hall, 235 North Street, North Reading, MA.

Mrs. Romeo moved, seconded by Mr. Rooney and voted 3-0: (Mr. Pearce abstained and Mr. Spear absent)
that the Community Planning Commission vote to accept the minutes of February 15, 2005.
20 Main Street – Eastgate Plaza
Mr. Rodgers stated that he received a letter from John Lucci, property owner of 20 Main Street. John Lucci expressed his concern in regard to the Community Planning Commission’s request that he place planters in the parking lot. He stated that there have been two car accidents involving these planters. He would like the Community Planning Commission’s advice on what should be done.
The Community Planning Commission will visit the site after tonight’s meeting. A letter will be sent to John Lucci with their recommendation.
Zoning Board of Appeals
92 Concord Street – On the petition of Atlantic Tambone, Inc. by their Attorney, James Senior for a variance from the parking requirements.
The Community Planning Commission does not support the application for the following reason:
- The applicants should follow the Site Plan Approval or return to the Community Planning Commission for an amended plan.

Kylie Way – Definitive Subdivision – P.H. 8:00PM
Mrs. Romeo read the Public Hearing notice into the record.
Rich Williams of Hayes Engineering stated that the proposal is to build six residential house lots on 10.8 acres. The road proposed will be 500’ to the center of the cul-de-sac. One item to note on the plan is the right-of-way radius of 25’. The road pavement has been placed so that the 30’ radius fits, but there would be a small sliver left, and so, they decided to make it part of the layout.
The drainage has been a major concern in the stormwater management area. The preliminary plan showed the stormwater management area located in the rear of lot 1. A meeting was held with the abutter of 237 Elm Street (Mr. DiMeo). Mr. DiMeo wanted the stormwater management to be pushed away from the lot line as far as possible (100’). This has been accomplished. The drainage design was submitted to the Conservation Commission, who then hired consulting engineers Green International. Green International has reviewed the design and comments were sent to Hayes Engineering. Green International was concerned with the storm septor and a maintaining well. They suggested that the Conservation Commission issue an Order of Conditions to have the storm septor pulled out of the
right-of-way and a monitor well placed in the stormwater management area. Test pits have been done to determine what the groundwater level is, but they would like to see if it is consistent with Green International’s testing.
The design provides for mitigation for all the storms so that the rate of run-off is not increased at any of the sub watersheds. One watershed drains out to an intermittent stream, which flows underneath Orchard Street and then out to the Ipswich River. The other small watershed goes across Route 62. None of the water flows leaving the site are increased based on the designs. Based on recommendations from the Town Engineer, they have connected the outlet from the drainage system for the roadway into the existing piped drainage system in Route 62. Drywells have been added to the front of all houses so that the roof area can be recharged throughout the lots. Two water hydrants will be placed at the beginning and end of the street.
Mr. Pearce asked when the monitoring well would be placed in the stormwater management area.
Rich Williams stated that the monitoring well would be placed in the next few weeks.
Mr. Pearce asked where the drainage in the street would discharge?
Rich Williams stated that there is a 12” drain that flows from the east into a manhole and then there is an 18” pipe from the manhole to the wetlands.
Mrs. Romeo read the Planning Administrator’s (2/23/05), Water Department’s (2/14/05), Fire Department’s (2/2/05) and School Department’s (2/2/05) memos into the record.
Mr. Hayden stated that the name of the road should be of a historic background, and suggested John Bickford Way.
Rich Williams asked if there was a shorter way to use this name?

Mr. Pearce suggested Bickford Lane.
Mr. Hayden stated that the sight distance information be provided for review.
Rich Williams stated that he would submit this information.
Tom Hatch of 0 Strawberry Lane stated that at the preliminary hearing the drainage issues were a major concern and would like to know if these issues have been resolved.
Rich Williams stated that a reduction in flow has been provided for 0 Strawberry Lane.
Ed Garbarino of 6 Pleasant Street stated that he has seen surveyors surveying property that he has been maintaining for 30 years in the rear of his lot , between the two stone walls, and he considers this to be his property.
The Community Planning Commission stated that this would be an adverse possession claim and he would have to go through the court system.
Mr. Hayden stated that the following information should be provided before the next scheduled meeting.
1. Green International report – Review from the Town Engineer.
2. Traffic sight distance information.
Mrs. Romeo moved, seconded by Mr. Pearce and voted 4-0: (Mr. Spear absent)
that the Community Planning Commission vote to continue the public hearing for the Kylie Way Definitive Subdivision plan to March 29, 2005 @ 8:30PM.
Nutter Road – Citizen Petition - Rezoning – Public Hearing 8:30PM
Mrs. Romeo read the Public Hearing notice into the record.
Edward Lipinski of 9 Nutter Road stated that he is representing the petition this evening. He is in favor of the petition.
Mr. Pearce asked Edward Lipinski why he is in favor of the rezoning?
Edward Lipinski of 9 Nutter Road stated that it does not affect many lots except for changing the setback regulations and he does not see a problem with the zoning change.
Mr. Pearce stated that there are some lots that may be combined and a subdivision could possibly be built. This would increase the density. The Community Planning Commission is usually asked to do the exact opposite and not allow more building to be done in the residential neighborhoods.
Norma Stiles of 25 Nutter Road stated that most of the lots located on the street are non-conforming already and she does not see why anyone would find it a problem if four additional lots were made.

Mr. Hayden stated that there is a possibility that several lots could be made.
Mr. Spear arrived at 8:40PM.
Edwin Stiles of 25 Nutter Road stated that the lots are non-conforming anyway so a couple more houses will be no problem.
Mr. Pearce stated that he does not want to encourage a precedent.
Public hearing closed at 9:05Pm.
The Community Planning Commission will make their recommendation to be made at April Town Meeting.
